Thanks and correct, I didn't fully explain everything here, but I definitely did to the mechanic, and even showed a video of the exact problem.To answer your question: you have zero recourse. You didn't explain (here) what the exact symptoms were, whether there was any pattern to the "periodic" failures, what the history of this battery was, etc.; did you describe them to the mechanic? Normally a mechanic would perform tests on the battery, starter, solenoid, etc. and one or more of those might fail; did the mechanic describe what testing was done and what the results were? I'd quickly go out of business as a mechanic because in the case of anything even remotely challenging to diagnose I'd take forever explaining to the customer how many possibilities there could be, exactly how I'd approached pursuing each one, what unexpected results I'd had in the past when a problem appeared to be one thing and turned out to be another.... in fact I'd probably spend 90% of my day talking and not actually doing anything.
I don't recall exactly what they told me about their testing process, but I know they said they pulled a code (I did have an EPC light at one point which went away), but I don't recall what the code was, and that they were eventually able to duplicate the problem. I know that they didn't mention to me the battery at the time (i.e. they never said they tested it and it was fine), so either they never did, or they did and it was fine (but then failed a load test days later). Actually, after the 2nd visit when they called to tell me the battery failed a load test, they commented that the battery was an original Audi battery and looked pretty old. I therefore assume they didn't even look at it the first time as they never commented about it being old/thought to replace it.
In any case, I guess lesson learned that this perhaps isn't the mechanic for me.
