I just wanted to update this thread that sadly the negotiation with my neighbor fell apart when I realized before he approached me about the block wall fence, he and his contractor had already decided where the fence was going without getting a survey. When I raised concerns about it, he cancelled the job and stopped talking to me. I went ahead and got a survey and now realize as part of his recent ADU construction project he laid concrete down in places between 3 and 4 inches across the property line. He also left his old fence posts up just over the property line behind my old wood fence that I need to replace. The neighbor refuses to talk to me now in spite of my numerous attempts to work something out with him. He seems to want to block me from putting up my own fence so he can later put up a cinder block fence. I am in the process of hiring an attorney now. It seems since I have done a survey I should be able to legally remove the old fence posts on my property to put up my new fence, as long as the old fence posts entirely on my property. I'm just not sure.
